But you're right What's funny is when it's said and done Dude still did all that ranting and doesn't have his C note yet (though I'm sure he'll get it in a min).

(Also I didn't get to say it but it was funny as hell when you told dude no matter what he said you'd be $100 richer. That was a classic).

(Damn I forgot you're the cat that said rappers do the stuff they say in songs LOL).

Tony,
Please point out a single line in my post that could be considered defamation.
Yes, it is true that fraud is considered illegal, but your name was not including in that comment. That general statement stands alone to underscore my other comments.
However I do repeat that based on what I have seen of your practices, and the way you treat your customers, I wouldn't dream of doing business with you, or your company. And that is my personal opinion like it or not.
You missed a perfect opportunity to elevate yourself by failing to promise and eventually deliver a "killer" product to" theshine" regardless of the way that he went about his query.
Everybody makes mistakes, but you could have shown that you are at least trying to rectify yours. Instead you tell him that he can NEVER buy the product from you again.Bearing in mind that no one has even seen this product!
Which good business man does that in a public forum when faced with an angry, unsatisfied customer?
If you want to make this episode even more embarrassing for yourself, then I suggest that you attempt to sue me for defamation.
But be fore- advised, I am intimately acquainted with the law.

Firstly... Tony has sold me stuff on a few occasions and always delivered and offered good advice, i have yet to be dissapointed, i didn't buy high end stuff or huge plugin bundles, just a few bits...but excellent service actually, fast polite and acurate.

Second, i agree offering reassurance about the DVD and asking for a lil more patience would have been a prefered option for Tony maybe, but the dude was pissed of and shouting from the rooftops, fair enough maybe on many points but a personal crusade is over the top...

Plus, everyone asking or suggesting dude chilled enough to resolve this in a more rational way was insulted repeatedly, not exactly helping his cause..

The issue of Tony as a gear seller and mod is valid, but then again so what? He don't hide the fact and offers decent prices, no one ,makes you buy... personally it has worked well for me....

When the refund is completed let us know Shine, i for one would like to know.... then maybe everyone can stop the various witchhunts and get back to gearlust and mixing and producing knowledge....

This whole episode has been blown out of proportion but at the same time if you take peoples money in lew of a product that's not ready, it's asking for trouble i guess..

Finally, Tony...when you deliver a dope DVD it'll set all this straight...i look foward to seeing it.. and ThaShine... you have been honest in your feelings a lil rash in your chosen words at times maybe making a few to many enemies for your own good here in further disscussion...

But good luck to all...let us learn.... all of us!

Let's not forget that "The shine" only went off after Tony had closed down a thread in which others were questioning the long delay of the DVD.(as he has closed others)
That annoyed me, and I didn't even Pre-order!
I consider it to be a flagrant misuse of his powers as a moderator.
It was a case of upset the retailer, and have to deal with the moderator as a consequence.
If he cannot separate the two roles of Moderator and retailer, then he should drop one of them.
As for all of the other posters who were trying to get "theshine" to calm down by calling him childish, and irrational, well I found that quite bizarre as well. They were definitely not impartial, and came across as if they were almost affiliated with High Profile audio.
With ridiculous comments like " It's only $100" etc.
It would have been enough to turn the pope into a raging bull!

Ahhh Young Grasshopper,

Perhaps YOU are taking this all too personalheh

Guys you know I thought about this some. Dude has a right to be pissed. But all jokes aside (Eventhough that's hard for me to do on this subjectheh),

You know what's strange about this:

If dude had come out and said "TONY I WANT MY MONEY BACK!!!" in the beginning of all this. He would have probably got it and by now he could have spent it all on Kanye albums (unless he likes 50). The key to all of this for him should be his Cnote. If I were in his shoes I wouldn't care who moderated what, I wouldn't care about getting to the bottom of "EXposing" Tony etc... LOL. I'd care about getting my money back. IF that's his main concern

Why didn't he ask for his money back?

We have all compared this to Digi and guitarcenter, or other companies etc.....

If this were a situation with a large company,
Wouldn't you go into the store and ask for your deposit back BEFORE you started acting out?

He seems more addicted to telling us about it in a bunch of different threads than he is to trying to get his dough back.

Honestly,
Wouldn't you ask for a refund before all of this?

I don't see what the problem is.It is quite obvious that Tony didn't deliver the product in a reasonable amount of time, so why doesn't he do the right thing and refund the money and take orders when there is an actual finished product to sell?

Also it seems fairly unethical to take pre-order money from people on a product that is only in the conceptional or creative/developmental stages (this is highly unorthodox) . Pre-orders are typically taken on products that are completed entities, and are in the mass production and/or packaging stage.

Does Tony really expect people to not be upset? This is bad business. I don't know Tony, he may or may not be a great guy and perhaps he just bit off more than he could chew. Whatever the case may be, it is his responsibility to step up, be a man of his word, and do right by those who have put their trust in him.

If he does do the right thing, then it is our responsibility to forgive.

So why not just say "Tony I didnt get the product in a reasonable time. I want my money back instead of cussing out everyone at GS?

I won't build Tony up in this, but I won't lie on him either. Taking pre orders on a product that you are planning to do is not unethical.

You're going a bit far with that one.

Tony did say when he set the pre order up that he was in the planning stage. So anyone who bought in, was fully aware of that.

There's nothing unethical about it. It's just a DVD that took longer than it should in production.

I wasn't aware that the person hadn't asked for his money back (guess I should have read a little further back). That does make this thread a little silly. And as for giving money to a person for a product that they are "planning to do", that is just plain foolish (that is not how proper business is done anywhere that I know of).

From a site admin point of view my views are as follows.

1) The pre order offer for the DVD slipped under my radar, its just come to my attention as an issue. My stance on the delay of it and its completion isn't particularly original, I think it needs to be finished ASAP and all pre orders honored.

2) All GS moderators receive free banner ad credit to use as they chose, Tony's banner is only visible in the USA, some of the other mods have banners that are only visible in Europe so the moderator banners you see depend on where in the world you are located. I can tell you that most of the sites moderators make use of this benefit and 11 out of 12 moderators do operate commercial interests that relate, even if in some way, to the forum membership.

3) As for pimping and moderation, Tony has been asked to be careful to not "over do it" with specific gear recommendations for products in his dealer range. This has been suggested not just for Tony's personal credibility as a forum contributer and moderator but also to guard against negative credibility by way of association for the forum. I myself do grow weary of several brands being mentioned over and over by Tony and will be speaking to him about it again.

4) Dealer participation as a whole is under general review at Gearslutz these last few months. Behind the scenes there have been some new private, guidelines issued to known dealer-members. To give one example sniping / infighting between them and the hijack of threads as a result will no longer be tolerated on GS and they can face suspension periods for doing it.

5) Last word - Tony needs to finish up his mixing project, finish up the DVD (and communicate off the forum to people that pre-ordered it). He and I will speak at the AES.

What we are failing to realize is that it wasnt the refund that i initially wanted, it was the product i wanted or atleast answers about the product i paid for and invested in almost a year ago.... They are questions that he still havent answered and he still havent answered are we missing this??

It would be just like any other situation if you purchased a defective or the wrong product from a GC or where ever you don't go right in yelling for a refund unless maybe you already had plans to do so, But as an innocent customer you would just like a replacement or something to be worked out in order to make "YOU" the customer Happy or atleast comfortable with doing business with them in the future! Right?..

Then by me asking questions i get banned for insults all of a sudden and all threads not even closed but completely DELETED! they were containing all of the information that would allow one to understand why this happened or even got to where it's at and also included a few of Tony's responses and excuses which still never answered the questions about the DVD's Manufacturing company and the official release date and most of all A REAL Snippet of some exclusive footage on this so called DVD that he has been promising to us preorderer's for months.

Oh and for the record i still have not received my refund after me and tony PM'ed each other and i gave him my paypal transaction ID# and information for which. ..... Will update when refund is completed!

Normally, taking pre-orders on something you are planning to do is a waste of time, cuz no-one's gonna actually give u money till the product is there.

However, at a place like gearslutz, where everyone is so passionate, and so desperate to find that ONE piece of gear they believe will make all the difference in their sound, i guess you can expect a bunch of people will shell out dough for the THAUGHT of being able to see what Jimmy Douglas does to mix hit songs.

Another account banned for no reason juels what's up?????

Also just to let everyone know another account has been banned by (Gear Slutz) for no apparent reason unless asking questions about a product that i paid for is against the Law or Rules and if they keep doing this i will take this outside of these forums and expose this non-sense....

They are doing it in a real slick way were they are seemingly allowing me to post a viewable public thread but once i log out no one else can see what i just posted only i could when im logged in. Not good!

Excuse me but Jules, This is where he (tony) over does or over did things because he keeps making all those who didn't preorder the DVD feel as though they were missing something ( which they werent ) by informing them openly about the Special guess ,Features ect... which pressures them to fight between spending money or feeling left out and i've watched him do this quite a bit to people.
I think by him starting everything from the forums it should be kept on the forums so that every one could know what is going on ..There should be no secrets...and ecspecially if there is nothing to hide so please remove or change this to something more suitable for eveyone so that there will be no room for negative situations such as the DVD one.
And please stop someone from banning my accounts for no reason or better yet re-activate my first one because there were no solid reason for th deactivation of it a little back and forth but from what i understand name calling/racism has taken place on these forums before and have been alot worst and accounts are still active to this day so i would appreciate it. Thankyou!

exactly. i just don't see why there's a need for all this drama, this is some 7th grade girl shi*, honestly. if you order a dvd and get frustrated with how long it's taking (which is understandable, completely), then hit the guy up directly, and either ask what the status is or ask for a refund. worst comes to worst, post a level-headed post in the forum just asking other members who ordered how they feel about the issue and what people want to do. i don't understand why it was necessary to bog down this forum with a post threatening lawsuits, filled with WHERE IS MY DVD!!!*@&@^@8 and crap like that.

all of that being said, tony, i do think some errors were made on your part, as over the top as some of these posts have been. its not my place to tell you how to do business because i know firsthand you have a very good rep in our industry, however, i think it is probably not the best idea to charge a pre-order for a dvd that is that far away from completion. i understand maybe you needed to gauge serious interest before investing your time, but i just think taking a smaller deposit, or at least keeping customers updated of what's going on would be a good idea. it may be a small item compared to your other gear, but as all of us know that small customer today might be your biggest customer 5 years from now, thats just how this industry is...so everyone should get a fair shake. as someone else said just live and learn, i really don't think this is that serious.

I wish they'd ban your IP address and be done with you already.

You've contributed nothing informative prior to this nonsense, and the fact that you're whining over a dvd on how to mix hip hop of all things, shows me that there is little to learn from you anyways.

You are the weakest link: Good bye.

And you are a Tony FANBOY read before you Kiss ass i clearly explained that the DVD was just for Entertainment/Experimental purposes as for i am secure with my mixing although one could never know enough and if it was that important to me id be doing what everyone else is out of fear of not getting it.. Kissing ass in your case and in others just staying silent about the bad service that has been given to those of us who actually paid. So actually it shows just what type of an ass you are for not knowing what you are talking about before you actually talk and pucker up. Read and learn first!!!! Now pucker up for one last Butt kiss before you Go - Now you are the weakest link-tutt Good Bye!!
