At least the indirect infringement case is going forward. I think this in someways is more important than the direct infringement. They all can legally hide behind the "we didn't upload the files" excuse for now.

If Hotfiles loses this then the other indirect infringers will fall like dominoes.

Not terribly surprising. The vast majority of cases involving service providers where the infringing content comes from users or via automated technical processes (like the search results from Google Image Search) have said there is no direct infringement by the service provider.

The indirect infringement claims are always the meat of the claims in these suits.
