Issue with a "client"

So I'm a student in a University. I did a recording for 2 songs with a band for free. We didn't have any legal or financial written agreements prior to the session. We just talked and agreed to do it for free. Then due to the Uni's workload I decided not to go on with the project and pass the sessions to the band to go on with the songs by themselves. But as it looks like for some reason some of the files are missing and I have no idea what happened. It might be my fault it might not. Now the the guys at the band are pissed off and asking me for some kind of compensation for the missing files saying that they put effort and time on this.

Any suggestions?

not a lawyer, but highly doubtful. The fact that you were doing a favor, donating your time, giving a gift, would normally weigh pretty heavily. Just tell 'em "sorry" honest mistake.

Actually, you learned a lesson (I hope) in a relatively painless manner.






Never, ever lose a clients files. Ever.
Always have a backup of everything.
No excuses.

Thanks for commenting Rick. The fact is I do keep backups all the time but I never keep them after I'm done with the songs...

You're on the right track. I'd suggest keeping the backups for at least a few months. Storage is cheap these days.

I used to keep backups for one year. A client called me about a year and a week after a session and needed the files I had just "smoked" the day before (talk about lousy timing!).............Even though I had practically begged him to bring over a drive and grab the files when we had finished the sessions 53 weeks before (I told him I would only keep them a couple of MONTHS AT MOST) somehow he expected me to magically make them appear...............I now keep all important files permanently. Actually pays for itself many times over and you look like a hero when you save the client's butt.

Fact is I always keep backups even after the song is done. What happened now is that i deleted the original sessions and kept just the one i was working on. Thing is that was the one with the missing files..

Yes I know how it sounds. I don't keep the original session just the one that I've worked on (mixing, editing or whatever) and when I"m done I usually trash everything and do a back up on that latest version of the session.

In that case i just did some editing and a rough mix, cleaned up the session's audio folder ( i think this is where the f@@k up happened) and backed it up.

Since they didnt pay you they really cant complain.

But at least now you know what to save for the future! Very important because it is still their material ya know!

they're cheeky twats for asking. Deserve a smack in the mouth for asking for compensation.... the dick heads.... when they fire their drummer ( everyone does sooner or later) then remind him to get compensation from them.
