Movie soundtrack contract question...

Hi, my band has been approached to include a song in a movie soundtrack. This would be a non-exclusive license. But the contract doesn't expressly state that it's non-exclusive. Can one of the more legal savvy members take a look at this contract and tell me if it looks legit? Thanks!

Hi, I'm not a lawyer but any film scores I've done have the ecxlusivity or non exclusivity mentioned in it. The term "other media" implies they can use it in a soundtrack cd release, and you get "one tenth of a gross point" but it doesn't say gross point of what. It also gives them publishing rights for this piece of music which I don't see why they need. If it were me I would prefer to see a non eclusive license for use in the film and promotion of the film. Then again, if it means a chance for good exposure for your band maybe it's worth doing, but I would still try to avoid signing over the publishing rights.

Yeah, I'm not sure why they would ask for publishing rights. The sentance says "necessary for usage/exhibition" but I should probably clarify.

Thanks!
