Talking The Lost Tapes

Discovered country music recordings prove to be a reel find - The Boston Globe

I don't know if somebody posted this, already. It is *technically* location recording...

This almost sounds like a hoax, but if not:

Holy. Cow.

Aren't these tapes pirated? I assume that the person who recorded them did not have permission. So what does that do to things like copyright or mechanical rights?

I would think that the artist would have to approve anything that was done with the tapes since it is their voices and instrumental playing on them.

Just wondering?????

If the songs copyright is still in effect then they will have to pay the fee to the copyright holder. Around 10 cents per copy per song.

If the performer wants to claim a copyright on the recording itself then I think they would have to show that they owned the recording. That could be difficult to do. Back then they didn't have express prohibition on recordings like they do now. I don't know how that would play out.

That only lasts 50 years - so if the tapes are older than 1959......

Copyright is still due to the song writer, though, as that lasts until (I think) 70 years after his/her death.
