sample clearance question

there are alot of underground indie cats that are doing 100k record sales,

to name a few mf doom, boot camp, all of stones throw and def jux,

i loook on there cd inserts and i rarely see credit given to the samples.

do you think these small labels that fly under the radar are clearing everything or

are they too small to be noticed or cared about?

I was having a discussion about this the other day with my boy,

I know that clearning samples safeguards you "IF" you do blow up with a track

you wont get into a costly law suit. but some of these cats are making a living selling 50k - 100k records i dont see how there budget can handle all the clearings yet they release them anyhow?

whats your take on this?

A lot of people don't clear samples.. If this is discovered, they can be suited.. I know people who have been suited.. Now a days, this is a major issue in the music industry..

i don't know if the artists you mentioned have cleared their ablum samples. Although i do know a few local artists who do not clear their samples before release.

i guess its all a matter of how low you fly on the radar, if you have something thats blatant then you prob need to clear it.

I wouldn't assume that the samples not being mentioned in the credits means that they weren't cleared.

thats true...as far as I know you are not requiere to put the credits of the samples even if they r clear, is just courtesy...same thing with credits on Engineering, mixing or putting the name of the studio...I got some cd release that they don't mention me as engineer, but they if I do the beats....I could be wrong, but that my understanding on the issue

there are occasions (usually stipulated from the publisher, not the original writer), where they get specific as to how you are required to credit the work being used
