Sampling 'The Meters'

Hi, I was thinking of using a Meters loop on a track. Does anyone know as they have been sampled a lot if you would have to give 100% publishing etc. on clearing the sample.

Hey it's cool i have the record and can clear all the publishing, i just don't really want to mess with the sample if they are known for taking all the publishing and writers credits.

They have been raped many times over! They are taking all of the publishing and charging atleast 15,000 to clear samples.

they are one of the most sampled bands of all time and they (or whoever owns their publishing) are used to making money from their songs by now. publishing and/or a chunk of $$$ always needs to be paid to the owner of the song if you plan on the song doing well "above ground". if its underground (less than a few thousand vinyl), many people don't worry about it. if it gets big enough, someone will contact you and you get a lwayer and deal with it although some people have been sued for punitve damages (more than they made) by angry publishers. my lawyer says this has happened. i don't worry about it as it is rare.

forget about clearing the sample. just put it out and deal with it later. since your posting on this board, chances are you are not a big time star, so they probably wont have much to come after you for.

i've only sampled the meters once, because they are way overused, but i couldnt resist chopping the handclap song.

Hey Thanks for the replies (really interesting !). The track i was going to use was an obscure 45 they wrote and produced for a female singer so it wasn't anything overused.. I think i'll leave it out... Hey respect on the 'Handclap', clip..

Interesting.So u think it still sensible to approach them even though u wont be selling a whole host of records?Clearing could be less though in that case, I'd presume.

In New Orleans I lived one street over from Art Neville and I had plans of hiring the guys for some session work (IF I could get them, since until recently they hadnt performed together in years). My 2nd plan was to contact Marshall Seahorn (an old friend of the family) to see if I could get copies of the original masters as separate tracks. I wanted to merge Hip Hop with New Orleans Funk as Dre did with George Clinton and P Funk. The meters are probably one of the MOST sampled groups in Hip Hop. (But there are alot of outtakes and other gems that ddnt make the records)

Most of the musicians that I work with @ home grew up in the same era as the Nevilles/Meters so that level of NEW ORLEANS FUNK is easily achievable.

I find that the caliber of musician from that era is much better than younger guys. Honestly since I grew up with, and went to school with many of the Neville children, it makes sense that musicians from this era have been honing there craft and playing longer than I've been alive

loooove the meters..I used to play in a band that just played parties and clubs and we would just improv live with a few songs to reference. The meters were always at the top of our list. they brought a lot of groove to the table and were amazing players.

no, i am just saying that my lawyer has told me that although rare, some people have been sued for more money than they actually made on their record and had to pay it. he, being a lawyer, can't say "put it out with no worries" but i get the idea from him and small label owners i know, that it is nothing to worry about if it is a small pressing. if the song becomes big, and you actually move some records (10000+ or whatever) and there is major college radio play ect and it seems that it might become a radio track or make some real money on a tv commercial ect...then, you probably can assume you will want to deal with sample clearance . you get a lwayer and have him contact the publisher. yes, if you clear a sample before the record goes out (and does well), you will save some money. but many publishers are tough and expect good money regardless. i wanted to sample a pretty unknown newcleus song and thought that it might be pretty cheap to clear. in that case my lawyer said that the publisher was "really difficult" and expected good money if they would clear it at all. i have no idea what the amount was but it was enough that he knew i wouldn't be up for paying it-many thousands. i wanted to release the track in hopes of it selling well (lots of promo...) and wanted to take care of it before it became a problem. now, my philosophy is,. dont worry about it. set up a limited liability corporation, and release your tracks under that. if someone deserves to get paid because you actually get money (which is very rare) on a releases, pay them their fare share (lawyers will figure it out). should you get in a nasty lawsuit even after trying to pay the publisher, declare bankruptcy and shut down your llc.

back home in nyc now, but got new orleans in my heart .

i saw the meters play a bunch down there. they put on a sick show.
i guess they are called the funky meters now, with some white boy playing guitar (if i remember correctly)

Nah if you saw the Funky meters you didnt see the METERs. The funky meters were a spin off but as of Jazz Fest last year, the guys perform as a group again.

yeah i guess it wasnt the real meters, but the 2 times I saw them, once in 02 at jazz fest (i think, im blurry) and in halloween of 03 at howlin wolf it was george porter and art neville playing, so it was still pretty sick.

yeah i was UPT for 4 years, palmer street, near claiborne. catch me at dunbars killing it with the red beans and rice and fried chicken. dope sweet tea also.

Namedrop: I know Zig and his wife, they are some of the nicest people you'll meet. Very mellow and cool. Never asked him how he feels about being sampled so much.

The Original Meters did some shows last year, but I missed 'em. Hopefully, they'll do more this year.
