Offered a deal in Japan, need some advice !

Hi,

One of the largest independent record companies in Japan has contacted me about my talkbox tracks. I have made a couple of talkbox albums. They want to release a 'best of' from my two albums.

I currently selling cd's via cd baby. And have signed to there digital distribrution. Ie via Itunes, US, UK and Japan.

But this will be a new best of album!

This is the first offer outline:

Advance: 2,000 USD (requires Residency Certification)
Royalty: 18% of wholesale price
Term: 5 years exclusive
Territory: Japan only (including digital distribution rights in Japan)



(requires Residency Certification) Not sure what this means ?

Proof of address ?



If I take the advance i wont get paid until they recoup the 2000 usd?


I guess i will have to contact to Cd baby, and tell them to stop selling the
tracks which will be on 'best of' album via Itunes Japan ?

looks about right. I'd take the deal and see what kind of travel they'll throw in for "promotion". ultimately, you'll do better on an expense paid trip to Japan than you will on the advance - but life is for living.

given the way things are, If it were me, I'd waive the advance for the "promotional" trip. tokyo is awesome.

maybe you'll develop a following there. the japanese are slow to make any deals these days, so they must really dig yer stuff.

This does sound good, but you should have a renegotiating mark in your contract. I would say after 2-3 years. This way if things are not going so well you can go about your way, and if they are going in your favor then you can always up the numbers. That is what I would do since it is a "best of" from your previous albums. Everything is already set in place, just go with the flow, and always KEEP record of you contacts. Be smart and play your cards right. Good luck!!!
