A sad Ebay tale- Ronnie Brookshire

Ronnie Brookshire list a mic preamp for sale on Ebay. i was the winning bidder, $2,475.00. then he contacts me and tells me he didn't get a high enough price and he is canceling the sale. i cantacted ebay- they say they can not force a seller to sell. (what good is Ebay then?) stay away from this scoundrel.

lessons learned:
1. don't buy anything from Ronnie Brookshire
2. if you sell something on ebay and don't like the price you got, just cancel the deal- no penalties from ebay
3. ebay sucks

well that's what feedback is for. don't let him try and get his ebay fees back. let him burn for $200.

Indeed - they can't force him to do it. A small claims court might be able to. Under no circumstances should you agree to cancel the transaction. Definitely leave him negative feedback.

Had a similar situation when purchasing some gear about 6 years ago. The item had a really low buy it now price so I clicked and paid. The seller refused to sell the item for that price and after several emails and phone conversation still reused to honor the contract.

I had my attorney send him a letter concerning what the lawsuit against him would entail and I had the item within 3 days.

The attorney cost was $150 but the item was worth it.

I've had a couple of minor tales from eBay. I bought a 16ft K-Tek boom pole for £500. Pink Noise was the seller, they've got a website as well as the eBay outlet. I've not dealt with them before, but they didn't look too bad, had good feedback, and had what I wanted in stock.

It didn't arrive and a week after the supposed delivery date I rang the seller. He said that it was sold it on the website the day after I bought it, so no longer had it. That's fine, but he knew that this was the case when I rang him. I gave him the grilling of a lifetime and told him that I should report him and the business for knowingly letting people give them money without any intention of delivering their goods. I got a refund and luckily found the same K-Tek, brand new, but with an extra 5 feet for half the price a day later from a private seller. If you ask me, this guy ripped himself off so much, he could have outed it at 95% retail instead of about 35% – it was so brand new that the packaging was unopened.

I'm not saying everyone has bad experiences with Pink Noise, but it needs to be mentioned.

And the moral of the story is women are impressed by men with long poles.

If you want to wade through it - ask a lawyer. Afaik, according to German law, for example, if you're the highest bidder at the end of an auction (even if the seller cancelled it, because someone made a fixed price offer per PM!), it's equal to having signed a contract and you can file a suit for fulfillment of the deal, which means, you'll either get the item for the last bid offered, or the seller has to refund the current market value of the item.
That will only work for national deals within the same jurisdiction, off course.

Or you could leave negative feedback and move on. The deal has cost you no money. You started the process with your cash and no product, you ended the deal with your cash and no product. You've lost nothing. So just neg feedback and forget about it. Starting a campaign of hate won't change a thing.

I can't begin to count how many times I've bought something that showed a number of items in stock, only to find that I couldn't get delivery of the product. My procedure is very straightforward. I ask for the tracking # within days. If I don't get an acceptable response or delivery by the expected date, I leave negative feedback starting with the word "FRAUD" and listing the total $ amount lost. I've had a number of sellers come back whining about this response, but my response to them is that if they don't want to be identified as a fraud, they shouldn't act like one.
