One could argue a few objective mix problems.

Instruments are not separated. Such as notes being obscured or vocals being buried in the mix.

The OP stated he had a few objective directions given to the mixer, like panning of a guitar. This is a clear cut "you didn't do your job" piece of evidence.

Not having a written and SIGNED contract is what will hurt both sides and a judge may outright throw the case out.

This has been my experience as well. I learned a lot of lessons from small claims court. The side that cuts to the chase and has the evidence to substantiate their side typically wins. If you bloviate your chances of winning diminish.

I guarantee you that the judge will not ask to listen to the mix.

The quality of the mix itself will have nothing to do with outcome of the court's decision.

This is exactly the same reason why the client doesn't have a chance in winning the case.

Bad engineers will always be around and its the client's responsibility to find and hire the right man for the job. Once you agree to pay you have to pay; regardless of the outcome.

Man, the court would be more expensive than the job he had to do. No contracts...its your word against his. Or...youll need an Ae judge! Stay cool. It wont get nowhere!

you have a leg to stand on, if he states not happy dont pay on his website end of story. If you didn't get the full mix then he lost nothing, because it states not happy don't pay. you can change your mind there is no fine print stating when you need to be happy. If i eat a big mack and i'm completely happy after eating but later i get food poisoning then I realized after further examining I am not happy. All you did was further examine the sample and realized after extensive listening its not what you wanted. He has no leg because he clearly states satisfaction guaranteed.
