manthe! Hey man!

Well I have to agree with you strongly on this one. I've never understood this case against UAD. Number one: they have, what are to my ears, the best plugs out there. And two: they run on their own power. Three: I only have two cards and have yet to run out of power. I mean I don't ONLY use UAD on mixes and my computer is moderately powerful, being a Dual 2.7. But DAMN, I stopped using Waves because I just didn't particularly like them, especially for the price. To me the UAD is a complete no brainer.

But you know, to each his or her own.

Have you guys been visited from any one at UAD yet asking subtle but probing questions about how many instances of the 33609 Compressor you are able to use?

One more....2 more OT things to add

UA is a GREAT company to work with. Courteous, understanding, helpful and fast support and customer service. They've even reset trials for twice!

Also, When I compared the Waves SSL to the DUende, I preferred the Duende. I know they went after different consoles, but the the sound of the Duende ultimately won out for me. I know I can (probably) run fewer instances, I also know I am one of the luckt ones for whom the Duende actually works properly!)

PS - Henry, I STILL have that card! I tried it with M-Powered but it was way flakey on my machine. I broke down and bought an MBox2 Pro (I needed 96k). I HATED spending that much for the ability to convert projects but.....oh waiut...we're b1tching about Waves, right? Not Digi...

Anyway even if was paid..I do not think an newbie in the audio biz can even charge $300 buck to record a song,,,that do not cover any Waves product...so to charge $20,000 is a bit to much.....

I was not really worried about paying for WUP (but I do think it is a bit like a ransom), it was more the fact that if waves shut down and I had brought the SSL bundle, what would happen if something went wrong with my software? I'm going to hold off buying until it looks like things settle down, I don't have money to risk.

No 'dude', the only basis I have is what a friend who sells audio software said to me. All I am doing is asking if anyone knows anything. 'wtf' is wrong with that? Most people have been helpful.

If you friend cannot reasonably qualify what seems like a 'bombshell' assertion it may well be completely unfounded.

Still he could be right, and it may be true.

Waves are proving themselves too greedy…
Some of you may remember the story from my earlier of a friend who was caught by the spies… quick recap; an Israeli band wanted to finish their recordings in his new studio but requested waves, which he didn’t have. He got a tryout copy of from the net and demoed it to the (fake) band saying (from the secret tape) “I’ve never actually used it”. When questioned further he said he had Bundle as well but when asked for proof he couldn’t provide any because he was making it up to secure the client. Waves demanded nearly US$10,000.
Hands up, on the advice of his solicitor he offered them everything the studio had, $4,000, for licence of plus costs.
Waves turned that down and are now asking for around $12,000 including $4,000 for damages (What damages!). That’s about $6,000 more than the company is worth.
What are Waves hoping to achieve with this. This was a small studio run from a home garage, not a big corporate studio that charges stupid amounts of money.

Or just a good one who told him to tell waves to bugger off.. If he never used the trial version on a session and their reason for wanting him to buy a license is because blagged about owning a package when he didn't, then waves really will be laughed out of court.

As someone who was visited by the SoftPolice, I'm mostly concerned with the ethical implications of their agents surreptitiously filming and taping the conversations.

It's certainly unethical to record a conversation without the consent of the third party. Sadly it does not seem to be illegal in NY.

Of the 50 states, 38, as well as the District of Columbia, allow you to record a conversation to which you are a party without informing the other parties you are doing so. Federal wiretap statutes also permit one-party-consent recording of telephone conversations in most circumstances. (footnote cited)

Twelve states forbid the recording of private conversations without the consent of all parties. Those states are California, Connecticut, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Pennsylvania and Washington. (footnote cited)


If anyone had a visit in one of those states they would have some added legal recourse.

I personally plan on complaining to their lobbying firm in DC.

I wonder if someone, a legal expert so to speak could make up a disclaimer/release stating that you do not have any unauthorized software to your knowledge and any demonstration versions on their computers are strickly that, demonstration versions. This agreement would also release and hold harmless the property owner from any liability if unauthorized plugz/software were found on the studios computer and that any video or recording of the facilities could not be used in a court of law and the only remedy available is the removal of said software. Have anybody that comes in to use/checkout the studio sign this release. If the person that works for waves or thier legal reprensentive signs this it should hold up as they are an agent for the company handling this. Just like the terms of use on the software, you would have your own terms of use before entering the studio, post it on the wall at the entrance in big letters and let everybody know that you won't tolerate customers/engineers putting "Warez" on your computers. One of the key elements is intent (I have been watching Law & Order) and if you show you are diligent in trying to prevent unauthorized software usage in your place, you can get out of it if you ever go to court.

Yea, see the end of my post on page 3, #75. Unfortunately you're gonna freak out & kill the "vibe" for every artist that wants to record at your place by throwing a stack of papers in front of 'em to sign. And if their lawyers are good enough, they'll find a way around it. But it seems like this is what he world is turning into lately

Does anyone know if any of these Waves cases have actually gone to court or if Waves have accepted anyones out of court settlement?

They're accepting settlements. Bust last time I checked (last month or so) no court actions have been filed (In U.S. Federal Courts).
