Is this a rip-off / plagiarism?

Part of a more than ten years old rather obscure German audio drama:

Track from the 2010 album of German electronica act Kollektiv Turmstrasse:

What do you think? My opinion on this is already settled.

It would only be plagiarism if Kollektiv Turmstrasse claimed that it was entirely their own composition.

It's certainly different enough to justify having made it. It only winds me up when someone simply reproduces the original with no artistic development whatsoever:

Folks, I'm not asking for examples or legal opinion (I'm an expert myself), but what you think as musicians/producers/composers in regards to how the second track came about. To put it another way: Is the second track more or less based on the first one composition-wise, or is it a completely unique composition?

It's hard to say. They sound similar, but it's not like I've never heard that chord progression before. Instrumentation is similar, but again... it could just be coincidence.

They sound somewhat similiar but not that close. Neither one of them could be accused of being that interesting either.

Kraftwerk and Rammstein - "they ain't".
