Chances are if they can't shut them down, someone didn't do their legal homework. Why do you think there's so many Fender clones out there? Fender invented the Stratocaster (or atleast release it...) in 1953. They really took no major legal action on the old crappy "made in Japan" (...remember those days?) knockoffs. I'm pretty sure it was the 70's and the aftermarket parts that made them take notice (...along with companies like Ibanez making "clones"). They basically let years go by before they took major action and all they really own is the headstock design. Some circuits (...like most Fender amp circuits) are practically public domain. Pretty much all Fender owns is trademards like "Twin Reverb", "Deluxe Reverb", etc. You notice there isn't any Rickenbacker clones? Ric sues everyone and their dog that even tries to build anything that resembles their product. They've done this since day one and they've succeded. You noticed Behringer has been sued by everyone from Mackie to god knows who else. Probably because Mackie has done a pretty good job protecting their circuits. Anyone dealing with "clones" really didn't take care of other areas of business. Maybe it was a simpler time, like when people didn't lock their doors. Otherwise, I'm pretty sure they'd sue if they could...
