So my guess is its either a case of my needing to update the driver/and or firmware or I need to change my firewire card?

Things to try

1: Disable 1394 networking (network connections)
2: If you have wireless, turn it off
3: make sure you have the 1394 patch that sets speed of the bus back to S400 or S800

If all that fails, try a new card
